Apple looks to add Samsung Galaxy S4 to patent infringement suit

Galaxy S4 outside Apple Store

Apple says Samsung's new flagship smartphone "is an infringing device"

Apple will move to have the Galaxy S4 added to its patent infringement case against Samsung, court documents reveal. In documents filed with the U.S. District Court in California and published by The Verge, Apple says it has examined the handset and "concluded that it is an infringing device." As such, it will add the GS4 to its list of infringing products, but remove one of the existing 22 so as to abide by the court's request that it limit the number of claims and devices.

The list currently includes such phones as the Galaxy Nexus, Galaxy Note, Note 2, Note 10.1, U.S. Galaxy S2 models and the Galaxy S3.

FBI to probe U.S. tax agency's actions on conservative groups

By David Ingram and Matt Spetalnick

WASHINGTON (Reuters) - Attorney General Eric Holder said on Tuesday he had ordered the FBI to open a criminal probe in a growing scandal over the Internal Revenue Service's targeting of conservative political groups for extra tax scrutiny.

Holder announced the Justice Department investigation as the tax agency's embattled acting commissioner, Steven Miller, traveled to Capitol Hill for meetings on the scandal amid Republican lawmakers' calls for his resignation.

The scandal has added to a sense of a White House under siege as President Barack Obama, who has promised to hold any IRS wrongdoers accountable, grapples with an array of domestic and foreign policy controversies that threaten his second-term agenda.

On Friday an IRS official revealed that the agency had inappropriately singled out conservative groups, some associated with the Tea Party movement, for extra scrutiny of their claims for tax-exempt status.

"I have ordered an investigation," Holder told reporters at a news conference. "FBI is coordinating with the Justice Department to see if any laws were broken."

He said that the actions disclosed so far "were, I think as everyone can agree, if not criminal, they were certainly outrageous and unacceptable, but we are examining the facts to see if there were criminal violations."

There were growing calls on Capitol Hill for the resignations of Miller and Lois Lerner, head of the IRS tax-exempt organizations office. Lerner apologized on behalf of the agency when she revealed the targeting of conservative groups last week.

Conservatives had complained about mistreatment by the IRS for years.

Miller was due to meet Senator Max Baucus, the Democratic chairman of the tax-writing Senate Finance Committee who has promised an investigation by his panel.

'HEADS NEED TO ROLL'

Senate Republican leader Mitch McConnell of Kentucky urged Obama to make all who knew about IRS misconduct available for questioning, and said there should be "no more stonewalling."

"Heads need to roll today," said Republican Representative Vern Buchanan of Florida, a member of the House of Representatives Ways and Means Committee.

The panel oversees the IRS and is scheduled to hold a hearing on the scandal on Friday.

Despite efforts by some conservative commentators to cast the IRS troubles as something akin to the Watergate scandal of the 1970s - or to former President Richard Nixon's use of the IRS to target his political enemies - there was no sign of White House involvement in the matter.

White House spokesman Jay Carney said the results of independent investigations must be known "before we can jump to conclusions about what happened, whether there was a deliberate targeting of groups inappropriately and, if that's the case, what action should be taken."

The IRS - which is supposed to be a nonpartisan agency - has suddenly found itself dragged into partisan politics at a time when it is also under increasing pressure to make rulings on campaign finance issues and matters related to Obama's healthcare overhaul.

Police identify suspect in New Orleans shooting

By Mark Guarino

NEW ORLEANS (Reuters) - New Orleans police on Monday identified a suspect in connection with a shooting at a Mother's Day parade that injured 19 people, including two children, as residents expressed outrage over the violence.

Police said the suspect, 19-year-old Akein Scott, remained at large but had been identified by multiple people.

"The time has come for him to turn himself in," New Orleans Police Superintendent Ronal Serpas said.

Serpas said Scott was last arrested in March and has a criminal history that includes charges for possessing narcotics and a firearm and resisting arrest. Police investigated three addresses linked to Scott but could not find him, Serpas said.

Earlier on Monday police released photos that they said showed a suspect in the shooting, which led to tips that helped with the identification.

"People today chose to be on the side of young, innocent children who were shot, and not on the side of a coward who shot into a crowd," Serpas said.

The image singling out the suspect did not clearly show a face, and police, who released the photographs on YouTube, asked for the public's help in identifying and finding the person. A $10,000 reward was offered for information that might help find the shooter.

The photographs, taken from a surveillance video, first show crowds of people in a street, and then the crowd is seen scattering and ducking. The final image focuses on what appears to be a man in a white shirt leaving the scene on foot as other people are lying on the pavement.

Ten men, seven women and a girl and a boy, both 10 years old, were shot when one or more people opened fire at the parade on Sunday. The children were grazed but in good condition, police said.

Serpas earlier on Monday said he had not ruled out that the shooting was gang-related or that there was more than one shooter.

Violent crime in New Orleans ranks above the national average in FBI surveys. A poll of residents in 2010 found crime to be their greatest concern.

Residents gathered Monday evening with religious leaders and Mayor Mitch Landrieu at the site of the shooting to voice their anger and discuss solutions for cutting crime.

"To all the young people who are committing the violence... I don't understand why jail is such a cool place to be. You're a coward," said Jessica Strange, a social worker.

Many of the people at the outdoor meeting had also attended the parade, which the sponsoring neighborhood club said it hoped to hold again in June depending on permits.

"We all came out here to basically reclaim this spot and to say what happened yesterday on this spot does not reflect what the people of New Orleans are or what we are about," Landrieu said.

"Yesterday was a symbol of a much, much deeper problem ... and the people of New Orleans are here today to say it's unacceptable and has to stop," the mayor said. "Nobody out there is at fault but everybody is responsible."

Are you an Internet dynamo or a dinosaur? | Small Business Radio ...

Sometime during the spring of 1995, you and I were given access to the Internet for the first time.

Since then, related innovations have produced a new marketplace where businesses of all sizes turn prospects into customers in a virtual, parallel universe. Here is a short list of the significant innovations:

  • E-commerce ? the ability to buy and sell online
  • High-speed internet replaced dial-up
  • Search engines indexing a gazillion online offerings
  • Mobile computing from convergence of mobile networks and smartphones
  • Social media transcending websites by connecting participants in online communities

After 10,000 years of the traditional marketplace, these innovations have at once produced unprecedented opportunity and disruption in less than 20 years. But here?s good news for small business: Part and parcel with the new capability is the incrementalization of virtual resources, which means they?re available in units and pricing that fit our focused (niche) applications and diminutive budgets.

We wanted to know how well small businesses are adopting the handy and affordable virtual marketplace tools, so in our online poll we asked: ?How much of your sales can you attribute directly or indirectly to your online strategy?? Here?s what we learned:

Only 5% of our sample reported that 100% of their business resulted from an online strategy, while double that percentage said they did ?more than half? of their business in the virtual marketplace. Just a few more, 12%, allowed that they got ?about half? of their revenue from the Cloud, while our big group, 55%, said ?less than half? of their business came from the Internet. And finally, almost one-in-five said the Internet produced ?zero? business for them.

It?s good news that 81% of our respondents are experiencing some business from their online strategy. Twenty years after the telephone was introduced in 1877, I wonder how many businesses had adopted that proto killer app?

But another way to look at small business?s virtual marketplace adoption is that almost three-fourths of our folks still associate less than half of their business in any way to an online strategy. Sadly, that troubling news could foretell the unnecessary extinction of way too many small businesses.

After almost 20 years, customer expectations are increasingly evolving in the direction of more virtual interaction. Which way is your business trending?

Don?t act like a dinosaur ? execute an online strategy.

Bearing up in Glendale: Another bruin takes to the city

Just as the memory of "Meatball," Glendale's favorite bear, may be fading, it appears a new bruin has taken to the city.

And this black bear ? described as 3 to 4 feet tall and weighing about 200 pounds ? has a fondness for hummingbird sugar water and a taste for honey. This dietary insight is based on its snacking habits during multiple visits over the course of at least six months to the Chevy Chase Canyon neighborhood.

In some cases, the bear has knocked down hummingbird feeders hanging as high as 8 feet off the ground.

"I was kind of surprised another bear is back," said resident Suzanne Whitman, whose bird feeder was knocked down about 4:30 a.m. Tuesday at her home on Chevy Chase Drive. The bear, she said, visited her home twice last year.

The bear may also be responsible for destroying Herbert Harder's small backyard apiary, which contained seven beehives that he had maintained for 30 years. Harder hasn't replaced the hives and isn't entirely sure he wants to take the risk.

It took only three visits for the bear to decimate Harder's honey crop and population of bees, he said. But the bear's fourth visit was the most devastating, since it tore apart several hives and sent others rolling down a steep hillside.

Harder's hummingbird feeders also found themselves on the bear's menu.

According to residents, the bear visited the Chevy Chase Canyon neighborhood at least seven times last year, including a foray into a trash bin for chicken, rice and baklava.

Other trash runs, door-pawing and sunbathing sightings have prompted police responses, including a helicopter search and the use of air horns and floodlights.

After spending winter in their dens, bears typically leave their hide-outs around spring and begin foraging for food, said Kevin Brennan, a biologist with the California Department of Fish and Wildlife.

A bear usually starts feeding on grass, but an urban bear may yearn for something a little tastier ? and fattier.

Human garbage, Brennan said, is higher in protein fat than a bear's natural diet, making the human food irresistible.

"Bears are smart animals and they go back to those sources," Brennan said.

With a very acute sense of smell, bears will go virtually anywhere and put up with almost anything to reach a source of tasty food, he said.

Though state wildlife officials were aware of a bear's past visits to the Chevy Chase Canyon area, they had not received any recent reports, Brennan said. Still, he added, "they are creatures of habit."

Harder said he wants the bear to be trapped and relocated just like Meatball, who was moved earlier this year to an animal sanctuary in San Diego County after twice being relocated deep within Angeles National Forest.

"He is going to stay here until he destroys everything or hurts someone," Harder said.

The gender of the bear has yet to be verified.

But trapping and relocating doesn't work, Brennan said, noting Meatball's persistence.

"The issue is not the bears. The issue is improper storage of garbage," he said.

Whitman, a neighborhood watch block captain, has urged neighbors to cover their trash bins and to keep small children and animals inside at night.

In her 25 years of living in the canyon, she said she has never before had visits from a bear.

"It's a little too much nature," Whitman said.
